Terms of use
This translation is for information only. If there is any discrepancy, the Spanish version prevails.
These terms are the rules for using xpoly.es and your customer account. Who Xpoly is and how to contact us is in the legal notice. What happens to your data is in the privacy policy. Pre-order reservations have their own terms of pre-order.
1. Browsing requires nothing
You can browse the catalogue, the stock in each shop, the pre-orders and the events calendar without creating an account and without giving us any data.
2. Your account
You cannot yet buy on the website. What you reserve is paid for and collected in the shop, and it is an in-store purchase: returns are not accepted if you change your mind, and you have the legal guarantee if the product is faulty or is not what you reserved (terms of pre-order, section 5). Your account lets you sign up for a pre-order on the website and see your reservations; in the shop, our staff sign you up, whether or not you have an account (terms of pre-order, section 1). The account is created with your email address, a password and your acceptance of the privacy policy; nothing else. You add your name, telephone number, address and date of birth when you need them —your telephone number to reserve, because that is how the shop contacts you; the rest, to verify your account— in ‘Your account’, where you can also correct them.
- An account belongs to one person. Do not share it, and do not reserve using someone else's account.
- Your details must be true. A false name or telephone number may mean we cannot tell you about your reservation, and on a verified account it will lead to the verification being withdrawn.
- Keep your password safe. We cannot see it: it is stored encrypted in a way that cannot be read. If someone gets into your account without your permission, tell us as soon as you find out.
- Your session is kept in two technical cookies while you browse (see the cookie policy). ‘Sign out’ deletes them.
- One email address, one account. You cannot open a second account with the same email address.
- To stop people trying to guess passwords, we limit the number of attempts to sign in and to create accounts from the same connection: if you go over the limit, wait a minute and try again.
3. Minors
To buy, you must be of legal age or do so with the knowledge and authorisation of your father, mother or guardian. Children under 14 may not have their own account: it must be created and used by their legal representative. High-demand items can only be bought by verified accounts, which require you to be 18.
We do not ask for your age when you create an account: it is this rule, not a filter, that determines who may have one.
4. The verified account
Some items are marked as high demand and, on the website, can only be reserved with a verified account. In the shops they are sold like any other item. Any account can request verification from ‘Your account’, and Xpoly grants it to every account that meets these requirements:
- the account holder is over 18;
- their identity has been checked once in one of our shops, with a DNI, NIE or passport (we keep no copy or number of the document: only who checked it and when);
- their contact details and address are complete;
- they have only one account;
- they have no outstanding unpaid amounts or chargebacks with us;
- and they reserve for their own use, not for resale.
In ‘Your account’ you can see which requirements you are missing and, if we refuse or withdraw verification, the reason, which is always one of these requirements. If you change your first name, surnames, telephone number, address or date of birth, the verification is removed automatically and you have to request it again, because it certifies those details.
5. Proper use of the website
You may not:
- use the website for anything illegal or to impersonate another person;
- try to access other people's accounts, the administration panel or parts of the website that are not public;
- send automated requests in bulk (bots, scrapers) that overload the service; the website and our network provider cut them off automatically above a certain rate.
If an account is used in this way, we may block it, telling you the reason. Blocking an account does not take away your rights over anything you have already paid for.
6. Closing your account
You can delete your account whenever you like from ‘Your account’, with the ‘Delete my account’ button and your password; this cannot be undone. In the same place you can first download your data, with ‘Download my data’. We delete your account data; whatever the law requires us to keep about your purchases (for example, for the tax authorities) is kept blocked for the period set by law and then deleted. The details are in the privacy policy.
If you do not sign in to your account for 2 years, we delete it. Before that, we warn you several times by email, the first time six months before and the last on the day itself, and simply signing in is enough to keep it.
7. Changes to these terms
If we change these terms, we will say so on the website with the date. Anything already done is governed by the terms in force when it was done.
8. Governing law
These terms are governed by Spanish law. If you are a consumer, you may bring a claim before the courts for the place where you live.
